Terms and Conditions
Auto Pay Requirement:
All monthly memberships require a valid card on file with auto pay enabled. This requirement does not apply to 6-month or 12-month prepaid memberships.
By enrolling, the member authorizes Roadside Relief to charge recurring membership fees to the payment method on file until the membership is canceled.
The member is responsible for maintaining accurate and up-to-date billing information.
Failed payments may result in suspension or termination of membership benefits.
Payment Status:
Monthly members MUST be paid at least three (3) months in advance to be eligible for services. Services cannot be activated by calling in and making a one-time payment to cover missed months.
Returned Payments:
Any returned or declined payment is subject to a returned payment fee, which may be debited electronically from the card on file.
Members MUST have a valid government-issued photo ID and the registered vehicle information on file with Roadside Relief prior to receiving services.
The member must be present in the vehicle listed on the membership at the time service is requested.
Each membership is valid for one (1) individual and one (1) registered vehicle only.
Membership benefits cannot be shared, transferred, or used by another individual, even if the member is present.
Only one payment card may be associated with each membership account unless otherwise approved by Roadside Relief.
Any change in the registered vehicle must be reported and updated on the membership account at least forty-eight (48) hours prior to requesting or receiving service.
Failure to update vehicle information within this timeframe may result in denial of service.
Paperless Billing Consent:
By enrolling online, you agree to opt in to paperless billing and electronic communications.
Membership Card Delivery:
Members consent to receive a digital and/or paper copy of their membership card, which may be emailed or mailed at the company’s discretion.
Eligibility & Approval:
Membership eligibility, dues, fees, benefits, and services are subject to change without notice.
Each individual may hold only one membership.
All applications and renewals are subject to approval and acceptance by Roadside Relief.
Cancellation:
You may cancel your membership at any time by calling or emailing us. Cancellations apply to future billing cycles only. No refunds are issued for prior or partial billing periods.
Membership services are provided subject to availability, location, weather conditions, safety concerns, and operational limitations.
Roadside Relief reserves the right to refuse or discontinue service if a situation is deemed unsafe, illegal, or outside the scope of covered services.
Membership benefits are non-transferable and may only be used by the registered member unless otherwise stated.
Roadside Relief may utilize independent third-party service providers to fulfill roadside assistance requests.
Roadside Relief does not control the actions, equipment, or performance of third-party providers and is not liable for their acts or omissions, to the fullest extent permitted by law.
Any disputes related to on-site service performance may be addressed directly with the service provider.
No Guarantee of Response Time
Roadside Relief does not guarantee response times, arrival times, or immediate service availability.
Response times may vary based on location, traffic, weather, demand, safety conditions, and provider availability.
We understand that roadside emergencies can be stressful. However, Roadside Relief maintains a zero-tolerance policy for rude, abusive, threatening, or disrespectful behavior toward staff, dispatchers, or service providers.
Such behavior may result in immediate refusal of service and/or cancellation of membership without refund.
Roadside Relief reserves the right to modify, suspend, or terminate membership terms, pricing, or services at any time without prior notice.
Limitation of Liability
Roadside Relief is not responsible for damage, loss, or failure caused by pre-existing vehicle conditions, mechanical or electrical issues, manufacturer defects, improper installation, lack of maintenance, or normal wear and tear.
Roadside Relief shall not be liable for incidental, indirect, special, or consequential damages, including but not limited to loss of use, loss of time, inconvenience, or loss of income.
Roadside Relief is not responsible for service delays or failure to provide service caused by traffic conditions, weather, road conditions, acts of God, accidents, governmental actions, equipment failure, labor disputes, or the actions or availability of third-party service providers.
Services are provided on an “as-is” and “as-available” basis, without warranties of any kind, express or implied, to the fullest extent permitted by law.
This Agreement shall be governed by and construed in accordance with the laws of the state in which Roadside Relief is registered and operates, without regard to conflict-of-law principles.
Any legal action, claim, or dispute arising out of or relating to this Agreement or services provided shall be brought exclusively in the state or county courts where Roadside Relief is headquartered or primarily operates.
The member consents to personal jurisdiction and venue in such courts.
At Roadside Relief’s discretion, any dispute, claim, or controversy arising from or relating to this membership or services may be resolved through binding arbitration rather than court litigation, except where prohibited by law.
Members agree to waive any right to participate in a class action lawsuit, class arbitration, or representative action against Roadside Relief.
Claims must be brought on an individual basis only.
The member agrees to indemnify, defend, and hold harmless Roadside Relief, its owners, employees, contractors, and service providers from any claims, damages, losses, liabilities, costs, or expenses (including attorney’s fees) arising from:
Misuse of membership benefits
False or inaccurate information provided by the member
Violation of these Terms & Conditions
Actions or omissions of the member or any third party present at the service location
Any attempt to misrepresent identity, vehicle information, location, or eligibility, or to abuse membership benefits, may result in:
Immediate denial of service
Cancellation of membership
Forfeiture of fees paid
Roadside Relief reserves the right to investigate suspected fraud or abuse and take appropriate action.
Force Majeure
Roadside Relief shall not be liable for failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to natural disasters, severe weather, pandemics, power outages, government orders, labor shortages, or emergencies.
Severability
If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Entire Agreement
These Terms & Conditions constitute the entire agreement between the member and Roadside Relief and supersede all prior or contemporaneous communications, representations, or agreements, whether written or oral.
Roadside Relief reserves the right to refuse service or terminate membership at its sole discretion for violations of these Terms & Conditions, safety concerns, nonpayment, abusive conduct, not following terms and conditions or unlawful activity.
